These Terms of Service (“Terms”) govern your use of https://subtotaldistribution.com (the “Site”), operated by Subtotal Distribution LLC (“Subtotal,” “we,” “us” or “our”). By accessing the Site or placing an order, you agree to these Terms and to our Privacy Policy and Return Policy, which are incorporated by reference. If you do not agree, please do not use the Site.
You must be at least 18 years old, or the age of majority where you live, to place an order. Minors may use the Site only with the involvement of a parent or guardian.
If you create an account, you are responsible for keeping your login information confidential and for all activity under your account. Notify us right away at sales@subtotaldistribution.com if you believe your account has been used without permission. We may suspend or close accounts at our discretion.
We work to describe and photograph our products accurately. Many of our surfboards are hand-built and hand-finished, so color, finish, weight, and dimensions may vary slightly from board to board and from the images shown. Colors may also look different depending on your screen. These variations are a natural part of handcrafted surfboards and are not defects.
All prices are listed in U.S. dollars and are subject to change without notice. Products are subject to availability, and we may limit quantities or discontinue products at any time. If a product is listed at an incorrect price because of an error, we may cancel any order placed at that price and will notify you.
Your order is an offer to purchase. We may accept or decline any order, including for suspected fraud, pricing errors or limited availability. If we cancel an order after you have been charged, we will issue a full refund. Payments are processed securely by our third-party payment providers. We do not store your full payment card details.
Shipping times are estimates, not guarantees. Title and risk of loss pass to you when your order is delivered to the carrier. Please inspect your board on delivery and report any shipping damage to sales@subtotaldistribution.com as soon as possible, ideally with photos.
Returns and exchanges are governed by our Return Policy. Any applicable product warranty is limited to what is stated in that policy or provided by the manufacturer.
Dealer and wholesale purchases may be subject to separate pricing, minimums and terms provided by Subtotal. If those terms conflict with these Terms, the dealer terms control for those purchases. For dealer inquiries, contact sales@subtotaldistribution.com.
Surfing is an inherently dangerous activity that can result in serious injury or death. You are responsible for choosing equipment suited to your ability and the conditions, and for using it safely. To the fullest extent permitted by law, you assume all risks associated with surfing and with your use of any products purchased through the Site.
All content on the Site, including text, graphics, logos, photographs, video and designs, is owned by or licensed to Subtotal and the brands we represent. It is protected by copyright and trademark law. You may view and print content for personal, non-commercial use only. You may not copy, modify, distribute or use any content for commercial purposes without our written permission.

We do not guarantee that the Site will be uninterrupted, error-free or free of harmful components.
To the fullest extent permitted by law, Subtotal and its owners, employees, suppliers and partners will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or our products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify and hold harmless Subtotal and its owners, employees and partners from any claims, losses or expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or misuse of the Site or our products.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in San Diego County, California, and you consent to that jurisdiction.
